Rules of Sale

Dům pro Julii, z.ú., IČ 07020180, with its registered office at Ečerova 14, 635 00 Brno, is the operator od a public collection with the purpose of gathering voluntary financial resources from the preparatory work, construction, and equipping of the children's hospice House for Juliet, for the operation and organization of Dum Pro Julii, z. u, and for the salaries of workers in direct care and the website www.dumprojulii.com (hereinafter referred to as the "Operator").

These sales rules (hereinafter the "Rules") govern the relationship between the Operator and a person who wishes to contribute to the public collection (hereinafter the "Contributor") through an order placed at www.dumprojulii.com/dobry-obchod. By confirming the order, the Contributor acknowledges and agrees to the Rules.

1. Introductory Provisions

Public Collection

The Operator conducts, in accordance with Act No. 117/2001 Coll., on public collections, a public collection notified to the Regional Authority of the South Moravian Region under ref. no. S-JMK/50590/2020/OSPŽ. The purpose of the public collection is to gather voluntary financial resources for preparatory work, construction, and equipping of the children's hospice Dům pro Julii, for the operation of the organization Dům pro Julii, z.ú., and for the salaries of workers in direct care (hereinafter the "Public Collection").

Contribution to the Public Collection

By placing an order at www.dumprojulii.com/doby-obchod the Contributor contributes to the Public Collection, either through a gift certificate (hereinafter the "Certificate") or another item (hereinafter the "Item"), the price of which includes a contribution to the Public Collection.

In the case of a Certificate, the Contributor has the option to choose the area of support - 

FAMILY SUPPORT.

By placing an order for a Certificate or Item, the Contributor contribute to the Public Collection, The amount of the contribution to the Public Collection is clearly stated in the description of the Certificate or Item.

The provision of the contribution to the Public Collection, in addition to these Rules, is governed by Act No. 117/2001 Coll., on public collections, and Act No. 89/2012 Coll., the Civil Code. Due to the non-commercial nature of the Operator's activity within the Public Collection, special rules stipulated by the Civil Code for the relationship between a entrepreneur and a consumer and for the sale of goods in a store do not apple to the relationship between the Contributor and the Operator.

The confirmation of the order establishes a contract between the Contributor and the Operator for the provision of a contribution to the Public Collection. Based on this contract, the Contributor is obligated to probide a contribution to the Public Collection. 

The Operator is obliged to send the orded Certificate or Item to the Contributor and use thr provided contribution for the purpose of the Public Collection, Further rights and obligations of the Contributor and the Operator are specific in Rules.

2. Ordering and Delivery Condition for Items

Ordering an item, the price of which includes a Contribution to the Public Collection

When ordering an item at www.dumprojulii.com/dobry-obchod, the Contributor proceeds by placing the selecting item in the cart and continues with the order, filling in the necessary information to issue a donation confirmation and process the order on the part of the Operator. The donation confirmation is automatically obtained by the Contributor with each order.

After completing the order, the Operator dispatched the item to the Contributor when paying by credit card at the earliest possible date after confirming the order. In this case, the Contributor usually recieved the item within 4 working days of order confirmation. In the case of parment by bank tranfer, the Operator dispatches the item at the earliest possible date after crediting the amount of the order to the Operator's account, account no. 2201801145/2010. The amount must be identifiable on the account under the variable symbol generated in the order and sent to the Contributor in the order confirmation. In this case, the Contributor usually recieves the item within 4 working days of crediting the amount to the account.

The Operator confirms the order by sending an email with a summary of the order to the Contributor's email address. The Contributor provides this address before completing the order.

Payment and delivery of an Item

Packaging is not charged by the Operator. The fees for payment and delivery correspond to the current price lists of the Contributor's bank and Czech Post on the day the order was placed.

3. Ordering and Delivery Conditions for Electronic Certificates

Ordering an Electronic Certificate

When ordering an electronic Certificate at www.dumprojulii.com/dobry-obchod, the Contributor proceeds by placing the selected Certificate in the cart and continues with the order, filling in necessary information to issue a donation confirmation and process the order on the part of the Operator. The donation confirmation is automatically obtained by the Contributor with each order.

The Operator confirms the order by sending an email with a summary of the order to the Contributors email address. The Contributor provides this address before completing the order. 

Following a successful payment, a certificate in PDF format is generated, stored on the Operator's server, and sent as a PDF attachment to the Contributor's email address usually withing 3 working days of crediting the amount to the account.

Fees for Electronic Certificates

Fees for payment correspond to the current price list of the Contributor's bank.

4. Ordering and Delivery Conditions for Printed Certificates

Ordering a Printed Certificate

When ordering a printed Certificate at www.dumprojulii.com/dobry-obchod, the Contributor proceeds by placing the selected Certificate in the cart and continues with the order, filling in the necessary information to issue a donation confirmation and process the order on the part of the Operator. The donation confirmation is automatically obtained by the Contributor with each other. 

After completing the order, the Operator dispatches the printed Certificate when paying by credit card at the earliest possible date after confirming the order. In this case, the Contributor usually recieves the Certificate within 4 working days of order confirmation. In case of payment by bank transfer, the Operator dispatches the Certificate at the earliest possible date after crediting the amount of the order to the Operator's account no. 2201801145/2010. The amount must be identifiable on the account under the variable symbol generated in the order and sent to the Contributor within 4 working days of crediting the amount to the account. 

The Operator confirms the order by sending an email with a summary of the order to the Contributor's email address. The Contributor provides this address before completing the order.

Payment and Delivery of a Printed Certificate

For the payment and delivery of the printed Certificate, no shipping fees are charged by the Operator. Fees for payment and delivery correspond to the current price lists of the Contributor's bank and the Czech Post on the date of the order.

5. Donation Confirmation

In the case of purchasing a Certificate, the Operator sends the Contributor a gift confirmation in PDF format attached to the Contributor's email address provided before completing the Order, usually within 3 working days of the amount being credited to the account.

 

For the purchase of an Item, the Operator sends the Contributor a gift confirmation upon the Contributor's request. The Contributor has the right to request the issuance of a gift confirmation by sending a request to the email address info@dumprojulii.com

 

The Contributor has the right to deduct the gift from the income tax base, provided that the conditions of Act No. 586/1992 Coll., on income taxes, are met.

 

For the Certificate, the gift automatically corresponds to the entire value stated on it. For the Item, the gift corresponds to the amount explicitly stated as a contribution to the Public Collection.

 

The Contributor has the option to request a gift confirmation retrospectively by clearly documenting their purchase through www.dumprojulii.com/dobryobchod. In the case of payment by credit card, the purchase is considered documented only if the Contributor provides, in addition to their identification details, the order number received in the confirmation email for that order.

 

Conditions for deducting the gift from the income tax base according to Act No. 586/1992 Coll., on income taxes:

 

Conditions for individuals, including employees (according to § 15 para. 5 of the income tax law):

Individuals (including employees) can deduct the value of gratuitous performance (gifts) from the income tax base if the total value of gratuitous performance (gifts) in the tax period (calendar year) exceeds 2% of the tax base or is at least 1000 CZK. In total, you can deduct up to 15% of the tax base. Self-employed persons (sole traders) apply the deduction of gifts from taxes directly in their tax return. Employees who file their own tax return apply the deduction similarly to self-employed persons – in their tax return. Employees for whom tax reconciliation is processed by the employer submit a confirmation of the gift to their payroll department once a year, no later than mid-February, for the entire previous year. The reduction of the tax base will then be reflected in the higher March payment.

 

**Conditions for legal entities (according to § 20 para. 8 of the income tax law):**

Legal entities can deduct the value of gifts if the value of gratuitous performance (gifts) is at least 2000 CZK. In total, you can deduct up to 10% of the already reduced tax base. For tax purposes, it must be at least a gift of at least 2000 CZK.

 

The House for Julia, z.ú. is entitled to the exemption of gratuitous income (gifts) from income tax (formerly gift tax). Thus, the donations that the organization receives are fully utilized. More detailed information can be found in Act No. 586/1992 Coll., on income taxes.

6. Complaints

The processing of complaints and the enforcement of rights arising from defective performance are governed by the Civil Code. Due to the nature of the Public Collection, the sale through www.dumprojulii.com/dobry-obchod is not subject to warranty and other conditions specified in the special provisions of the Civil Code regarding the sale of goods in a store.

 

The Operator handles complaints related to the type or quantity of sent Certificates, their execution, or their non-delivery. In the case of damage to a printed Certificate, for example, due to inappropriate handling during transport, the Certificate can be replaced by agreement.

 

If the electronic Certificate is not delivered due to an incorrectly entered email address, the Contributor can request delivery to a new address, and the Operator will try to comply and resend the email.

 

In the event that the Item shows signs of damage that occurred during transport, the Contributor has the right to withdraw from the contribution contract to the Public Collection and to a refund of the amount paid. Since it usually involves a limited collection of Items, it is not possible to address the complaint by exchanging it for another piece. The specific method of handling the complaint will be resolved by mutual agreement between the Contributor and the Operator.

 

In the case of a complaint, the Contributor is obliged to inform the Operator without undue delay by email at: info@dumprojulii.com. The email must include the information necessary to trace the order. If it is an electronic Certificate, in addition to the Contributor's identification details, these data also include the order date and order number, which the Contributor received in the confirmation email.

7. Security and Personal Data Protection

The Operator handles the Contributor's personal data in accordance with Act No. 110/2019 Coll., on the processing of personal data, and EU Regulation 2016/679, the General Data Protection Regulation (GDPR).

 

All information and personal or company data provided by the Contributor to the Operator during the contribution to the Public Collection through the order at www.dumprojulii.com/dobry-obchod is confidential.

 

The Contributor is obliged to promptly notify the provider of any changes to their personal or company data that could affect the fulfillment of the order.

 

The Operator is the controller of your personal data within the meaning of the GDPR. The Operator will process the Contributor's personal data to the extent specified in the order. The processing of personal data is based on the performance of the contract, the fulfillment of the Operator's legal obligations, and the legitimate interest of the Operator.

 

The data is processed for the following purposes:

- Processing the order

- Record of contributions

- Statistical purposes

- Fulfillment of the Operator's legal obligations

- Donor care, information about donation options, and activities of the organization Dům pro Julii, z.ú.

 

Personal data will be stored by the Operator for the duration of:

- The contractual relationship (contribution to the public collection agreement)

- The period specified by legal regulations (especially the Accounting Act)

- And for a further 3 years from the last contact with the Contributor unless the Contributor requests data deletion earlier.

 

The Operator does not sell or otherwise transfer personal data to third parties. The Operator may provide the name and order details to the bank upon its request in connection with the acceptance of MasterCard and VISA payment cards in the public Internet data network.

 

Contributor's Rights:

- The right to request information about what personal data the Operator processes

- The right to ask the Operator for an explanation regarding the processing of personal data

- The right to request access to this data from the Operator and have it updated, corrected, restricted, and the right to object to processing

- The right to request the erasure of personal data, or the right to withdraw consent (if given) at any time, for example, by sending an email or letter to the Operator's contact details

- The right to contact the Operator or the Office for Personal Data Protection in case of doubts about compliance with obligations related to the processing of personal data

8. Final Provision

These Sales Rules are published on the website www.dumprojulii.com.

 

The Operator is authorized to change and supplement the Rules. The Rules in force at the time of ordering are binding for both the Contributor and the Operator.
